OurOdysea LLC ("OurOdysea™", "we", "us", or "our") App Name: DoseStack™ Legal & Support: support@ourodysea.com Effective Date: February 15, 2026 These Terms of Service ("Terms") govern your access to and use of the DoseStack mobile application and related services (collectively, the "Services") provided by OurOdysea LLC. By downloading, installing, or using DoseStack, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services. 1) Acceptance of Terms By creating an account or using the Services, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available at https://dosestack.app/privacy). These Terms constitute a binding legal agreement between you and OurOdysea LLC. 2) Nature of the Services DoseStack is a personal health-tracking and organizational tool for logging, organizing, and reviewing self-entered information including medications, hormones, peptides, supplements, symptoms, wellness indicators, laboratory values, and related health data. The Services include dose tracking, injection site rotation, symptom logging, wellness assessments, AI-generated summaries, report generation, and data export features. 3) Artificial Intelligence Disclosure DoseStack incorporates artificial intelligence ("AI") features powered by third-party large language models (currently OpenAI). By using the Services, you acknowledge and agree to the following: A. AI-Generated Content Certain features of DoseStack produce content generated by artificial intelligence, including but not limited to: • Provider Visit Summaries: AI-generated organizational summaries of your self-entered tracking data, intended to help you prepare for healthcare appointments. • Pattern Observations: AI-identified patterns and trends within your logged symptom, wellness, and dosing data. • Motivational Messages: AI-generated motivational statements displayed within the app. • PDF Report Summaries: AI-generated narrative summaries included in exported reports. All AI-generated content within DoseStack is clearly identified as such and is provided for informational and organizational purposes only. B. AI Limitations and Accuracy YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT: • AI-generated content may contain errors, inaccuracies, omissions, hallucinations, or misleading information. AI models can produce output that appears authoritative but is factually incorrect. • AI-generated content is NOT reviewed, verified, validated, or approved by any physician, pharmacist, nurse, healthcare professional, or any employee or agent of OurOdysea LLC before being displayed to you. • AI-generated content does NOT constitute medical advice, clinical guidance, a diagnosis, a treatment recommendation, a prescription, a dosing recommendation, or a second opinion. • AI-generated summaries and pattern observations are automated reorganizations of data you have self-entered. They do not reflect independent clinical analysis or professional medical judgment. • The AI does not have access to your complete medical history, laboratory records, imaging, genetic information, allergies, drug interactions, contraindications, or any information beyond what you have voluntarily entered into DoseStack. • AI output may vary between requests and is not deterministic. The same input data may produce different summaries, observations, or messages at different times. C. No Reliance on AI Content YOU AGREE THAT YOU WILL NOT: • Rely on AI-generated content as a substitute for professional medical advice, diagnosis, or treatment. • Make any medical, pharmaceutical, dosing, or health-related decisions based solely on AI-generated content. • Interpret AI-generated content as an endorsement, recommendation, or validation of any medication, dosage, treatment, protocol, or health practice. • Present AI-generated content to a healthcare provider as if it were a professional clinical document, without clearly disclosing that it was generated by a consumer health-tracking application using artificial intelligence. D. Data Processing by Third-Party AI Providers • To generate AI content, your self-entered health and tracking data is transmitted to third-party AI service providers (currently OpenAI, LLC) for processing. This data is transmitted securely via encrypted connections. • OurOdysea LLC does not control the AI models, their training data, or their outputs. The third-party AI provider's terms of service and privacy policy also apply to the processing of your data. • We do not use your data to train, fine-tune, or improve AI models. However, the third-party AI provider's data handling practices are governed by their own policies, which we encourage you to review. • You consent to this data transmission as a condition of using AI-powered features. If you do not consent, you may disable AI features where applicable or refrain from using features that generate AI content. E. Assumption of Risk YOU EXPRESSLY ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF AI-GENERATED CONTENT. OURODYSEA LLC DISCLAIMS ALL LIABILITY FOR ANY HARM, INJURY, LOSS, DAMAGE, OR ADVERSE OUTCOME OF ANY KIND ARISING FROM OR RELATED TO YOUR USE OF, RELIANCE ON, OR INTERPRETATION OF AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO HARM RESULTING FROM ERRORS, INACCURACIES, OMISSIONS, OR HALLUCINATIONS IN AI OUTPUT. F. Indemnification for AI Content You agree to defend, indemnify, and hold harmless OurOdysea LLC from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of, reliance on, distribution of, or presentation of AI-generated content to any third party, including healthcare providers. 4) Absolute Medical Disclaimer READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. NO MEDICAL ADVICE. DoseStack does not provide medical, nursing, pharmaceutical, psychological, or therapeutic advice of any kind. NO DIAGNOSIS OR TREATMENT. DoseStack does not diagnose, treat, cure, mitigate, or prevent any disease, condition, or health issue. NO PRESCRIPTIONS OR DOSING RECOMMENDATIONS. DoseStack does not prescribe, recommend, endorse, or adjust any medications, dosages, treatments, or therapies. NOT A MEDICAL DEVICE. DoseStack is not regulated, approved, or cleared as a medical device by the FDA, EMA, or any regulatory authority. It is not intended for clinical use, clinical decision-making, or integration into medical workflows. NO PROVIDER RELATIONSHIP. No doctor–patient, provider–patient, therapist–client, or fiduciary relationship is created between you and OurOdysea LLC, its officers, employees, contractors, or affiliates through your use of the Services. NOT HIPAA-COVERED. OurOdysea LLC is not a HIPAA-covered entity or business associate. The Services are not designed or intended to comply with HIPAA, HITECH, or similar healthcare privacy regulations. NO DATA VERIFICATION. OurOdysea LLC does not review, verify, validate, audit, or confirm the accuracy, completeness, or correctness of any data, information, or content entered by users into the Services, including but not limited to medication names, dosages, frequencies, administration routes, injection sites, symptom reports, wellness ratings, laboratory values, or any other health-related information. All data within DoseStack is self-reported by users and has not been independently verified by any healthcare professional, pharmacist, laboratory, or agent of OurOdysea LLC. NO RESPONSIBILITY FOR USER INPUT. OurOdysea LLC bears no responsibility or liability whatsoever for errors, omissions, inaccuracies, or misinterpretations in data entered by users. If you enter incorrect medication dosages, frequencies, concentrations, reconstitution volumes, injection sites, laboratory values, or any other data, and you or any third party subsequently relies on that data, OurOdysea LLC shall not be held liable for any resulting harm, injury, adverse outcome, or loss of any kind. CALCULATIONS ARE INFORMATIONAL ONLY. Any calculations performed by the Services, including but not limited to dose calculations, reconstitution volumes, syringe unit conversions, weekly total dose derivations, compliance percentages, optimization scores, and injection site rotation tracking, are based entirely on user-entered data and are provided for informational and organizational convenience only. These calculations do NOT constitute medical advice, dosing recommendations, or clinical guidance. You are solely responsible for verifying all calculations with your prescribing healthcare provider before acting on them. OurOdysea LLC disclaims all liability for any harm resulting from reliance on app-generated calculations. REPORTS AND SUMMARIES ARE NOT CLINICAL DOCUMENTS. PDF reports, provider visit summaries, pattern observations, and any other documents or summaries generated by the Services are organizational tools designed to help users prepare for healthcare appointments. They are NOT clinical documents, medical records, prescriptions, lab reports, or professional medical assessments. OurOdysea LLC makes no representation that any report or summary generated by the Services is accurate, complete, or suitable for clinical decision-making. USER ASSUMES ALL RISK. You acknowledge and agree that you assume all responsibility and risk for any decisions, actions, or inactions taken based on your use of the Services, including but not limited to reliance on any self-entered data, app-generated calculations, reports, summaries, compliance metrics, optimization scores, or AI-generated content. You expressly release OurOdysea LLC from any and all claims arising from medical, pharmaceutical, health, or wellness decisions made in whole or in part based on information displayed in, generated by, or derived from the Services. CONSULT YOUR HEALTHCARE PROVIDER. Always seek the advice of a qualified healthcare professional with any questions regarding a medical condition, medication, or treatment. Never disregard professional medical advice or delay seeking it because of information displayed in DoseStack. You must independently verify all medication dosages, treatment protocols, and health-related information with your prescribing provider. 5) Not for Emergencies DoseStack is NOT designed for, and must NOT be used in, medical emergencies. If you are experiencing a medical emergency, call 911 (or your local emergency number) or go to the nearest emergency room immediately. Do not rely on DoseStack in any emergency situation. 6) Eligibility To use the Services, you must: • Be at least 13 years of age (or 16 in the EEA/UK). • Be legally capable of entering into binding contracts in your jurisdiction. • Not be barred from using the Services under applicable law. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. 7) Account Registration and Security • You must provide accurate, current, and complete information during registration. • You are responsible for maintaining the confidentiality of your login credentials. • You are responsible for all activity that occurs under your account. • You must notify us immediately at support@ourodysea.com if you suspect unauthorized access to your account. • We reserve the right to suspend or disable accounts that violate these Terms. 8) User Content and License • You retain ownership of all content you create, enter, or upload to the Services ("User Content"). • You grant OurOdysea LLC a worldwide, non-exclusive, royalty-free, transferable license to host, store, process, display, reproduce, and distribute your User Content solely as necessary to provide, operate, and improve the Services. • This license terminates when you delete your User Content or your account, except for content already shared or content retained in accordance with our Privacy Policy. • You represent that you have all necessary rights to grant this license. 9) Prohibited Conduct You agree NOT to: • Use the Services for any unlawful purpose or in violation of any applicable law. • Provide false, misleading, or fraudulent information. • Attempt to gain unauthorized access to the Services, other user accounts, or our systems. • Interfere with, disrupt, or damage the Services or connected networks. • Reverse engineer, decompile, or disassemble any part of the Services. • Use the Services to transmit viruses, malware, or other harmful code. • Use automated means (bots, scrapers, etc.) to access the Services without our written permission. • Misrepresent the nature of DoseStack as providing medical advice or clinical services. • Share your account credentials with others. 10) Subscriptions, Payments, and Billing • DoseStack offers subscription-based access to premium features. • Subscriptions auto-renew at the end of each billing period unless canceled before the renewal date. • All payments are processed through Apple App Store or Google Play Store. OurOdysea LLC does not directly process payment information. • Subscription prices are displayed at the time of purchase and may change with notice. • To cancel your subscription, use your Apple App Store or Google Play Store subscription settings. Deleting the app does NOT cancel your subscription. • Refunds are governed by Apple's and Google's respective refund policies. Contact Apple or Google directly for refund requests. • Free trial periods, if offered, automatically convert to paid subscriptions unless canceled before the trial ends. • We reserve the right to modify, suspend, or discontinue subscription offerings at any time. 11) Account Deletion • You may delete your account at any time through the in-app Settings or by emailing support@ourodysea.com. • Upon deletion, your personal data and content are permanently removed within 30 days. • Account deletion does NOT automatically cancel active subscriptions. You must cancel subscriptions through Apple App Store or Google Play Store. • Certain records may be retained as required by law (see our Privacy Policy for details). • For full details, see our Delete Account Policy at: https://dosestack.app/delete-account 12) Apple and Google Platform Terms • Apple Inc. and Google LLC are third-party beneficiaries of these Terms and have the right to enforce them against you. • Your use of the Services is also subject to the Apple Media Services Terms and Conditions and/or Google Play Terms of Service, as applicable. • In the event of a conflict between these Terms and the applicable platform terms, the platform terms shall prevail with respect to platform-specific matters. • Apple and Google have no obligation to provide maintenance, support, warranty, or indemnification for the Services. 13) Intellectual Property • All intellectual property rights in the Services, including but not limited to software, design, logos, trademarks, and content (excluding User Content), are owned by OurOdysea LLC or its licensors. • DoseStack™ and OurOdysea™ are trademarks of OurOdysea LLC. • You may not copy, modify, distribute, sell, or create derivative works based on the Services without our express written permission. 14) Disclaimer of Warranties THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION, DATA, OR CONTENT PROVIDED THROUGH THE SERVICES, INCLUDING AI-GENERATED CONTENT. 15) Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: • OURODYSEA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. • OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF USD $100 OR THE TOTAL FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. • THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE). • SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. 16) Indemnification You agree to defend, indemnify, and hold harmless OurOdysea LLC, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: • Your use of the Services. • Your violation of these Terms. • Your violation of any third-party rights. • Any content you submit through the Services. 17) Dispute Resolution and Arbitration • Governing Law: These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles. • Informal Resolution: Before filing any formal dispute, you agree to contact us at support@ourodysea.com and attempt to resolve the dispute informally for at least 30 days. • Binding Arbitration: Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Catawba County, North Carolina, or remotely at your election. • Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. • Small Claims Exception: Either party may bring claims in small claims court if the claim qualifies. 18) Termination • You may stop using the Services and delete your account at any time. • We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms, security concerns, or legal requirements. • Upon termination, your right to use the Services ceases immediately. • Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) shall survive. 19) Export Controls You agree to comply with all applicable U.S. export control laws and regulations. You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. government list of prohibited or restricted parties. 20) Modifications to Terms We may modify these Terms at any time. When we make material changes, we will: • Update the "Effective Date" at the top of these Terms. • Notify you through the app or via email for significant changes. • Post the updated Terms at our publicly accessible URL. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services. 21) Severability If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. 22) Entire Agreement These Terms, together with the Privacy Policy and Delete Account Policy, constitute the entire agreement between you and OurOdysea LLC regarding the Services and supersede all prior agreements and understandings. 23) Contact Information OurOdysea LLC 1424 6th Street NE Hickory, NC 28601 United States Email: support@ourodysea.com
